The Suprime Court on Tuesday has given stayed the Allahabad High Court order for " appointment of a court commission " to examine the premises of the Shah - Idgah Mosque in relation with the Krishna Janambhoomi  - Shahi Idgah Masjid dispute.

In this regards  A bench of Justics Sanjiv Khanna and Dipankar Datta  ordered in this case the proceedings before the High Court  may be continue but the Commission cannot be appointed till next date of hearing before the Suprime Court . The Court had earlier observed that the demand request filed before the High Court for execution of the local commissioner was very unclear selection .

According to Suprime Court that the prayer { for commissioner } , it is to unclear and it has to be specific. This is wrong you have to very clear what you want  him for you leve it to the Court, this is the unclear application. it is observed by Justic Khanna . In this behalf , the COURT added that the issue of the transfer of the case to another Court was also coming up and certain legal questions also arise for attention in the case.

Issue Notice ;-

In this an issue notice with Tag transfer matter , list on 23 January . While putting before High Court can continue but commission cannot be preposed till next date, this ordered. On Decmber 14 last year , the High Court  given in order had permissioned the application field on behalf of a Hindu Deity, Bhagwan Shri Krishna Virajman and 7 other Hindu Parties.

Regarding this the application was field of original suit pending before the High Court , in which Hindu Side has declare that the Mathura Shahi Idgah Masjid was built over Krishna Janambhoomi land.The Civil suit has been registred in the matter on behalf of a Hindu Deity Bhagwan Shri Krishna Virajman and other Hindu devotees. They have demand to removal of the Mosque on allegations that the Masjid was built over Krishna Janmabhoomi land.

The complaniants have again declear that there were many indications in support the view that the Shahi - Idgah Mosque is present in a Hindu Temple . Thats why an plea was made before the High Court to depute a commissioner to examine the Site.

In this behalf the principal suit is pending presentily before the High Court after trial Court legal proceedings in the matter were " transferred earlier this year " . The  case had initally dismissed by a Civil Court .

The Mathura District Court in May 2022 was held that the suit  { Case } .
