Anand Mahindra Faces FIR for Alleged Deceptive Car Safety Claims Following Fatal Accident

In Uttar Pradesh, an FIR has officially been filed against Anand Mahindra, the chairman of the Mahindra Group, and a dozen individuals. They are accused of allegedly disseminating deceptive information regarding car safety. Rajesh Mishra, a resident of Kanpur, initiated this legal action following the unfortunate loss of his son in a car accident, prompted by his filed complaint.
Mishra contends that he purchased a black Scorpio valued at Rs 17.40 lakh after being swayed by safety features promoted in advertisements and social media posts by Anand Mahindra. He had gifted this car to his only son, Apoorv Mishra. However, during the car accident, the airbags, which were expected to deploy, purportedly failed to do so, leading to his son's untimely death.
According to Mishra's complaint, "On January 14, 2022, my son Dr. Apoorv was driving back to Kanpur from Lucknow in the car. He and his friends were all wearing their seat belts (as mentioned in the police report). Due to dense fog, the car collided with the divider and rolled over multiple times, resulting in my son's immediate death," as reported by News18.
Mishra maintains that he would not have bought the car if the Mahindra company and the dealership had not prominently highlighted the vehicle's safety features in their advertising. In his complaint, he alleges that despite the seat belts being fastened, the airbags did not deploy upon impact, effectively accusing the company of providing misleading assurances. Furthermore, Mishra claims that he later discovered, through undisclosed sources, that the car did not even have airbags.
Consequently, he opted to take legal action by commencing proceedings in a local court, leading to the registration of an FIR. The FIR includes various provisions of the Indian Penal Code (IPC), encompassing offenses such as fraud, negligent behavior related to machinery, culpable homicide due to negligence, deliberate provocation of a breach of peace through intentional insult, and criminal intimidation
