The High Court had rejected his petition on August 17 without giving any reason. After this the victim reached the Supreme Court on 19 August. The Supreme Court had expressed strong displeasure over this attitude of the Gujarat High Court. Supreme Court Justice B. V. Nagarathna had said, 'A woman being raped is painful in itself. After this, if she becomes pregnant, it keeps reminding her of the old wound. In such a situation, we give permission for abortion to the victim as per the medical report.

In a 2017 privacy case verdict, a nine-judge Constitution bench of the Supreme Court had linked the right to pregnancy and abortion to the right to life and liberty under Articles 21 and 19 of the Constitution. But abortion and feticide are crimes under Section 312 and 313 of the IPC, so abortion can be done under the MTP law (Medical Termination of Pregnancy Act). This law cannot be misused for female foeticide.
➡ After the report of Shantilal Shah Committee, MTP law was made in 1971 and rules were made in 2003. After amendments in the law in 2021, new rules have come into effect in September 2021.

According to the law, rape victims, victims of sexual contact with relatives and other vulnerable women (disabled and minors) can undergo abortion up to 20 to 24 weeks on the advice of two doctors. After 24 weeks, the victim woman can file a petition in the High Court under Article 226 and the Supreme Court under Article 32, where abortion can be allowed after the permission of the Medical Board.

In 2017, Supreme Court Chief Justice Khehar had expressed concern over the threat to women's health and safety due to the delay in granting permission for abortion and the increasing cases in the courts. After that the Center had directed the states to constitute medical boards at the district level. If the old decisions of the Supreme Court and the guidelines of the Central Government are implemented in the state, then the victimized women will get timely relief and will also be freed from the hassles of the courts.
